Flight delay

Flight delay is a very unpleasant and unexpected circumstance that spoils the mood, rest, plans, and sometimes the whole trip. Every day, thousands of airline passengers suffer from flight delays, but only a few are aware of their rights and the ability to receive compensation.

If your flight is delayed and you find out about it at the airport, follow the simple instruction that will help to protect your rights:

  1. First of all don’t panic. Now you need to be careful and organized to protect your rights and compensate for the losses incurred.
  2. Contact your airline representative or service agent and request an official proof stating the reasons for the delay or cancellation of the flight. In case airline representatives refuse to provide such information, request them to make a mark with the above information directly on your ticket. Pay attention that the person to whom you applied for a proof must mention his position in airline company, full name and put a signature or stamp.
  3. Take a photo of the airport’s electronic scoreboard displaying the actual status of your flight.
  4. Collect all bills. We will need them all to the last.
  5. Do not accept vouchers and do not sign any documents – they may automatically deprive you of the right to receive appropriate compensation.

Compensation for delayed flights due to airline fault

The liability of the airline for damage caused as a result of delays during the air transportation of passengers on international flights (scheduled and charter) is limited to 4694 SDR (special drawing rights), which as of September 1, 2019 was about 5 800 euros.

The aforementioned airline liability limit specified in the Montreal Convention of 1999 is a norm of international law.

However, in the modern world, in case of delay during air transportation, the provisions of EU Regulation 261/2004 are more often applied.

At the same time, the Regulation 261/2004 does not contain a single rule on the payment of financial compensation for flight delays, but compensation is paid to passengers based on the court practice of European courts.

According to the provisions of the Air Code of Ukraine, for a flight delay of more than 5 hours, passengers must be provided with services (food, drinks, hotel, transfer, phone calls), as well as a renumeration. However, not a single Ukrainian airline complies with this norm.

If your flight is delayed, you can demand from the airline:

  1. Drinks and food after 2-4 hours of delay depending on the flight range.
  2. Hotel, if your flight is postponed for the next day.
  3. Transfer to the hotel and back to the airport.
  4. Two phone calls.

European practice

Ukrainian practice

In case of a flight delay of more than 5 hours, according to Ukrainian law- service shall be provided, funds can be returned for the unused part of the transportation or the entire ticket. Compensation by Ukrainian legislation, unfortunately, is not provided.

Israeli practice

In case of a flight delay of more than 8 hours – the amount of compensation is the same as that provided for cancellation and overbooking of the flight:

– 1,300 ILS for flights up to 2,000 km

– ILS 2080 for flights up to 4,500 km

– 3120 ILS for flights with a range of more than 4,500 km
